Sorry - this has prob been posted a million times - but the search brings up so much - inpossible to find a quick answer!

Not received!
Buyer saying I will have to wait until December before can take up with post office - but not happy that I have to wait that long.:mad:
Is that right - or should I just escalate it to paypal if not received by this time next week?

tell them that is not acceptable.
unless it was stated in the li8sting? although ebays guideline is 7 days to post.
inform them they either send it faster or refund.otherwise start a paypal item not recieved as soon as the options open0 -
I wouldn't warn them about starting an NPB. However, I would do as custardy suggests otherwise, email them again and say that you are unable to wait until December and assuming item is not with you in tomorrow's post you would like a refund so you can buy elsewehere. Then watch their auctions and next time they are due to have some finish slam in your paypal chargeback.
Alternatively open a basic paypal dispute now and email them through that explaining that you need either the goods or the refund this weekend. When RM consider an item formally lost (which is actually after 15 working days) is nothing at all to do with the buyer. The RM claim is between the seller and the RM and any seller that starts quoting that back at a buyer starts to look a little worrying.
I would go to a paypal claim as early as week 2 if the seller was un coperative or made any suggestions about waiting for weeks. Where a seller seemed reasonable and stated that they will refund maybe asking the buyer to wait a couple of days more I would then be more inclined to wait a bit longer.

There are a couple of things worth bearing in mind here:-
1) Paypal -> eBay link isn't working on all auctions at the moment. So there are auctions which are paid-for which aren't showing as paid in eBay. For any sellers who use the "items paid" list in eBay to do their shipping this may create a delay in dispatch. However - the OP seems to have contacted the seller direct and confirmed they have received payment.
2) RM is still backed-up in places from the strikes. We send a lot of stuff out and every now and again a whole bag will get delayed by a week. First class letters are taking over a week in some instances. It's not the seller's fault that RM can't control their unruly staff.
3) Soolin - AIUI where the seller acts as the buyers shipping agent, the goods are owned by the buyer and simply packed and stamped by the seller -- the RM claim is with the owner of the goods, not the dispatcher. However, I could be wrong in this regard - I'd love to see chapter and verse on it if you have. I appreciate the PP dispute doesn't respect this difference, but think the law does.0 -

The essence of contract between seller and buyer is the mutually agreed transfer of goods from the physical ownership of the one to the physical ownership of the other.
An eBay purchaser who buys from an eBay seller pays not only for the goods to be transferred into his / her ownership but also the associated costs of that transfer.
The eBay transaction therefore contains two elements:
a) The cost of the goods
b) The cost of transfer of those goods
The obligation upon the buyer is to meet the cost of both a) and b)
The obligation upon the seller is then to satisfy the buyer's entitlement to both a) and b), viz: to undertake the transfer of the goods from one physical ownership into another.
A seller who doesn't charge P&P is not excused his/her obligation; in volunteering to meet costs normally charged to the buyer they have effectively volunteered to act as the buyer's agent and so their responsibility remains.
Too many eBay sellers hold the view that "once it's gone, it's gone". Their idiotic T&Cs demonstrate arrogance or ignorance or, more usually, both.
PayPal, quite rightly, holds the view that unless and until physical ownership transfer is complete, then the buyer's legitimate expectations / contractual requirements have not been fulfilled, and so the seller is in default.
Physical ownership of goods is a cornerstone of Law and not the minor issue of academic interest that so many eBay sellers would like others to believe.
That's why there's often so much hassle in moving house: physical ownership -- the whole point of buying a house -- can often be held up due to last-minute delays in transaction completion (payment of monies).
But perhaps all those eBay sellers who like to delude themselves -- and others -- into thinking that physical ownership is of no consequence have never sat outside in a street with a furniture van, anxiously waiting to hear the two words in the English language which so succinctly sum this up:

Thanks :T - I have been emailing back and forth - and she did get stroppy - so I pointed out that I wasn't being funny starting a dispute, but that RM need to up the anti, and provide us both with a better quality of service! I paid instantly, and don't mind waiting ten days for goods - as I know service can be slow - but after that, imo it is unacceptable. I have also seen her sell the same item again - so wonder if she did post to me? I will wait until Wednesday - and then escalate. I just didn't want to escalate, and then be told I was too early!0
