Should have acted sooner

Hi

Just before Christmas my wife went to a restaurant and overstayed in their carpark. Soon after she received a letter and a fine, her manager who stayed in the same carpark didn’t get one. We did phone up the restaurant and they said they didn’t have anything to do with the carpark attached to them and therefore couldn’t do anything about the fine. After speaking to various friends and looking at various sites we decided to ignore this and any subsequent letters. You can probably guess what happened next, yes, I now have a Judgment for Claimant which I think is a CCJ? It is asking me to pay £153 for original fine (which was initially £50 and I wish I paid it) and £97 for costs. Is there any way out of this or have I sealed my fate by ignoring the other letters? The claimant is Britannia Parking and I am to pay BW legal Services.

Thanks for any advice

Pay the full amount and let this be a lesson that things will not disappear if you ignore them.
Maybe different from yours and more important, but I have learnt my lesson from the Inland Revenue and through my property tax.
Now I tackle things as soon as they are in my possession.

Just to be absolutely sure did you ignore a claim form?
  • if it was a ccj , it would just say total amount , not list charge then costs

What's effective date on the Judgment for Claimant?

You should never have ignored a court claim in March; that was defendable all day long, and well worth fighting.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The date of JofC is 16th April and they require first instalment of £40 by 15th May. Or I pay £250 as a one off.

So where did those figures of £153 and £97 come from?

Were they perhaps on the County Court Claim Form that your received but decided to ignore?

Instalments? Who has said that, BW Legal?

Without telling you that paying by instalments would clear the sum too late and leave you with a CCJ?

But there was no debt and the only sum in play was £100. The PCN.

Too late now. To avoid a CCJ you will have to pay in full as you ignored a Claim Form.
