Debit card chargebacks

in Credit cards
Sorry if not in correct section I purchased some items from Aliexpress all over £100 from same seller and the seller at first gave fake tracking then when it arrived items were missing and ones there damaged beyond use. I tried Aliexpress dispute but they didn't give me enough time to respond before closing in sellers favour (a day) I contacted my bank who said they can't help and I have to go through the sellers website.
Is this correct? I stand to lose about £450 over this.

There is no difference between chargebacks for debit card and credit cards and the £100 limit doesn't exist. The £100 limit only comes into play for 'breach of contact' claims under S75 when credit has been used.
So, on the basis that Aliexpress is a standard retailer and you didn't load up an ewallet to pay, your access to Chargebacks as a dispute remedy should not be hindered.
From what you say, you have not received some items and have received others that were defective. Those are both situations covered by Chargeback rules.
Visa rules are slightly different to MasterCard but only in relatively minor ways. However, both sets of rules will require you to first attempt to resolve the matter with the retailer and, if unsuccessful, you should be considered for Chargeback by your bank.
I wonder who your bank is because their advice seems to be a bit off - subject to the caveat in my second paragraph.0 -
It's Clydesdale bank, from what I was told by them since Aliexpress has its own disputes service I have to use them, this is despite me saying Aliexpress has sided with seller, basically its complicated the seller at first gave fake tracking details for a courier delivery (I chose free delivery as the courier one was £50) for a property over 300 miles away and a different name, I contacted seller and got nowhere and then eventually opened a dispute, on the day the dispute was to be escalated they provided a tracking number so Aliexpress told me to wait and it went quiet for around 3 more weeks and then package arrived, seller by this time is not responding at all and Aliexpress refuse to let me open new dispute
So it seems a scam from a seller.0 -
Assuming it’s a Visa card then it seems Clydesdale may have given you the wrong decision. Under their rules you’d need to:
1 - explain how the merchant has failed to resolve the issues (easy id imagine)
2 - return the goods you did receive
3 - wait 15 days for a refund
The goods would need to have arrived within the last 120 days. Missing and damaged items need to be reported to the merchant ASAP as well.0
