Raised decking in Scotland, what defines height?

Our wonderful neighbour has decided to build raised decking against our shared fence bang on 50cm high.
I'm wondering if anyone can confirm where this 50cm can be measured from? The decking has been built at the top of a slope so it's 50cm high at the boundry but from his house side it is well in excess of 1mtr.
Does he need planning permission for this?

I believe he does, because the floor level of any part of the decking must not exceed 50cm from ground level adjacent to the decking. As he has a sloped garden, the solution has to be stepped decking, keeping each level within the 50cm tolerance.0
