I received a letter from CEL a few weeks ago stating that they have discontinued proceedings, including a copy of the Notice of Discontinuance (Form N279). However, I haven't received anything from the court confirming the same – is this normal? I sent an email on 20 December with a copy of the letter and form attached, but the response time is up to 10 working days so I haven't received a reply so far.

Well done - a discontinuance is a win!  Another CEL one bites the dust!

    Give the court a call
  • To follow up on this, I called the court last December and I was told that they had received a notice of discontinuance from CEL. The lady couldn't tell me much more than that and I have since received nothing from the court by post, which still surprises me a little, but nonetheless the court date (14 January) has now passed without incident so it seems I really am free of all this nonsense.

I would like to thank all of the contributors to this thread and the wider forum. Your advice and experience gave me the confidence to stand up to CEL and I am of course glad that it all worked out in the end. I'm just amazed that it took nearly two years to resolve, but then I hadn't counted on CEL being quite so vindictive. I now know better!

    Thank you again.

    Good result.

You could do a final 'peace of mind' check by logging in to the CEL website and look at the charge's current status. Take screenshots for posterity. CEL can be a nasty bunch to deal with. Ask Co-op employees who were targeted by CEL when the Co-op cancelled their parking contract. They had been secretly taking and storing photos of employees' cars parked legitimately for work over a long period, then once they were shown the door, extracted their revenge by issuing PCNs to the staff.  Not nice!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
