Original ppi rejected but pelvin is approved

I had a search through the forum for similar issues but couldn't find clear answers to my queries, I today received an offer from Rbs for a pelvin payout for my credit card by using RESOLVER but my query is that when I originally tried to claim ppi from them it was rejected because of contradictions in statements which they asked me for more evidence which I couldn't gather. I tried again via the ombudsman but the time limit had expired.

Since I originally tried claiming those times things have changed and was wondering, the payment I'm being offered now is for the pelvin but am I still allowed to reclaim the ppi again which I was never refunded?

Also if I agree to the pelvin payout am I cutting myself off from the original ppi claim?

The letter states in the sign and return section "I wish to accept the banks net offer of £**** in full and final settlement of all or any claims which I might have against the rbs group or any subsidiary in respect of commission charged above 50% on my rbs ppi policy.

It also states that they only have details of my card records from 2003 and where they do not have details of the premium interest rates or any amounts charged are based on assumptions based on available data.. Can anyone explain what this means? Surely they should have full records of my dealings with them?

    Plevin is a separate issue. You were rejected and that remains the case in resepect of your complaint. However, they now have to consider plevin even on long rejected complaints.

    Plevin does not allow you to reopen the old complaint.

    The original complaint failed. It is over. Plevin has nothing to do with it.

    No. they should not hold full data. The GDPR (and DPA before it) required them to destroy data no longer deemed necessary. That tended to be around 6 years worth of statements until the PPI issue came to head. (so 2009 with 6 years back is 2003).

    Where they do not hold full data, they have to apply a range of assumptions. e.g. if you were not borrowing at the time of the earliest statements but only later, they will assume you were not borrowing on the card. Or if the other way around, they will assume you borrowed on the card for the period there are no statements. There is no other way to do this without actual statements.
