Help defending court claim from ParkingEye for 15 minutes overstay

None, because your defence relies on your entirley plausible version of events that day. You wouldnt expect them to damn themselves, so you dont rely on that.
If you can show the driver was elsewhere in between, fab, if not it has to be whether the judge believes you on the day - come across as credible, with asolid, consistent story, point out the KNOWN FLAWS in ANPR that the BPA etc have admitted to, and you should be OK. the system is NOT infallible, it DOES miss vehicles, and this is whats happened.0 -
Actually, it is reprehensible that a parking firm are erasing an image they hold of a car at a time in between a 'first in/last out' PCN.
Clearly it is fair/relevant to the PCN to keep images captured within contravention time.
So, if they missed one exit due to outside factors obscuring the VRN, they probably had one other entry (or vice versa), all along. To erase that and then say in court 'we can't find any images in between' (not admitting that is because they deleted them) is arguably fraudulent.PRIVATE 'PCN'? Guys, many thanks for your continuous support. My case has been transferred to my chosen court for hearing allocation but I am not sure if I will be able to attend physically. I do not have a permanent job and I may lose more financially if I have to take even half a day off for the hearing.
Is there any chance of winning it if I let the hearing happen without myself being present there?0 -
Unlikely in an overstay case v ParkingEye. Maybe you need to email them and offer settlement as a two-figure sum?

Many thanks. I have got a response from PE and they are offering £125. Any idea, how to deal with PE when negotiating a settlement amount?0

You just email them back and offer £60 this time, unless you want to chance the hearing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have offered them £65 but they kept replying "we note that the points raised within this correspondence are similar to those raised within your defence. The queries you have raised will, therefore, be answered within our reply to defence, which will be served upon you in due course".
I have now decided to attend the court hearing and realised that I have up to 16 August to submit by Witness statement. I would appreciate your help again if you point me to some good example of the witness statement similar to my case.0 -
I attended the hearing and won the case. Many thanks everyone for your support0

Yay - another one bites the dust! I am glad you didn't settle after all, were you able to prove it was a double visit then?
