Claiming PPI after Failed IVA

Hi - needing advice. Took out an IVA (Debt Free Direct) in Sept 2009 with my Husband. We separated in Dec 2012 and I was made redundant (main income) the same month. I was unable to make any payments on the IVA and rang to advise them of this and gave a forwarding address. I have never received any correspondence from them or any of my Creditors/Debt Agencies since that date. I have checked all 3 Credit References Agencies and there is nothing showing on my Credit File for any debts and I am not on the IVA Register/Bankruptcy Register. However, due to looking to repair my Credit File I have contacted Aperture (DFD sold IVA to them) who have provided me with lots of information. An Annual Report and Notice of Non-Compliance was sent to the Court by the IVA Company but not until 20th November 2015? This is 6 years after taking the IVA out. No payments were made to the IVA after Dec 2012 so why would it not be terminated until then?

The last payments made to my Creditors was in August 2014? The previous payments were in 2012 so a break of 2 years? I am unsure as to why this would be?
Does that mean that the last time my debts were acknowledged was 2014 so they wouldn't be classed as Statute Barred?

On top of this I am wanting to claim PPI against my biggest Creditor - Northern Rock and have started the ball rolling with an offer being received however, they state that they would have to inform Pamlona (company who have taken over the debt) to remove the PPI from the loans as there is still a balance outstanding??
Does that mean that the debt is still live?

Sorry for so many questions but I'm so confused.

Any help would be appreciate.

    No, it means for the purposes of your PPI complaint that the redress will be going first towards the unpaid debt with only any excess (if any) going to you. What you describe as the PPI being "removed" will be the action of offsetting

    Note that even statute barred debts continue to be owed, it's just that your creditors can no longer pursue you through the courts.

    You asked about all this in September last year;

  • Thank you - yes I did ask in Sept last year but have just decided to re-look at it - thank you for the reminder!
