DEKRA Report

Hi, so to cut a long story short.
I attempted to reject a brand new car within 30 days due to a gearbox whine happening within the first couple hundred miles of using it.
Dealership kindly told me where to go, so I utilised the finance company which is now coming up to 8 weeks on their complaint and they are having an independent company "DEKRA" come out tomorrow to assess the car.
I have no doubt whatsoever that their findings will be the exact same as my claim, however, the finance company have instructed me that this is just exactly that, a report.
Question I keep asking myself is why are they paying 300 pounds to get someone to report on it if it's "just a report"?
They are fobbing me off with lines like "The dealership has the final say" which I'm sure is not true, but could anyone enlighten me if that is the case?
Surely this report would put the claim to bed really and proceed on with the rejection?

Have you formally raised a Section 75* claim with the finance company?
* Section 75 of the Consumer Credit Act 1974 makes the finance provider jointly and severally liable with the seller for the performance of the contract, including any legal liabilities the seller has in respect of consumer legislation. Basically, if the seller has a legal responsibility, the finance company has that same responsibility.0 -
Have you taken it to another dealer? Are you using the supplying dealer? You only have CRA against the supplying dealer and finance.0

Yes, I sure did. I done this within the 1st 30 days.
As confirmed, DEKRA have now been and have completed their report. All he could do was laugh at how bad it actually is for a brand new car.0 -

Dealer didn't want to know anything about it, so I took it up with finance who instructed DEKRA to compile an inspection/report.
The man has been and gone and his independent report is backing me 100% he said.0 -
Which dealer? That sounds shocking. Did you explain to the dealer its a claim under CRA not the warranty? You still need to purse the dealer, they and the finance are jointly liable. I'd return the car to the dealer with a letter (LBA) and copy in finance. I take it you are rejecting the car?0

I did, they were well aware that I was using the CRA and that it was being rejected. I dropped the car off there for a whole week, but it just sat there and they don't zilch about it... Never even contacted me.
At that point, I took it back as the clock had stopped and complained to finance company. It's being dealt with by them now and AC said they will not speak to me, only the finance company. I am no longer in the loop with AC, their words.0 -
I assume that they want a report, because you want to reject the car. They need to satisfy themselves that it really is faulty, and you're not just trying to get out of a finance deal early because you've changed your mind.
I don't suppose the finance company wants to get involved in fixing it.
If the report agrees with you, then you should be able to hand the car back and have the finance agreement cancelled.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -

Yea, I just found it sketchy that the finance company said "We have to come to an agreement with the dealer" Like no, the report was the deal and the report states otherwise. I'm not a massive fan of their choice of words, but you would be right in saying the report agree's, it agree's with every aspect covered.
I'll give them a call today to ask for an update since the report when in yesterday.0
