Then would have been better in a new thread. And I do think your question relates to the bank holidays, because in a non-bank holiday month presumably you and your colleague working different days are paid for the same number of hours?

Regardless, it is NOT discriminatory to treat you and your colleague differently, unless protected characteristics come into play, eg those with particular characteristics are employed on Mondays, and not on Wednesdays, and vice versa. Which seems unlikely.

It would not be discriminatory for you to be on completely different salaries, but I guess that's a different discussion.

    Can anyone offer any help?
work 30 hours per week and am salaried for this. My working week due to service needs includes every Monday of a 10 hour shift so my BH average comes into force.
My colleague also works 30 hours and is salaried the same. She does not work Mondays and her 10 hours shift is on a Wednesday. This colleague is receives compensation for the Bank holiday as per the BH average.
I understand that no one should be penalised for not working a Bank Holiday but if the 'worker' has no control over the of the days of the week required to work and receive the same salary, for exactly the same hours per week, month, year - how is this not discriminatory as I am not contracted to work specific days.
It seems to me that I am being treated differently than my colleague and there is no parity.
Can it be fair that it comes down to the luck of the drawer which days a worker is required to work despite being salaried for the same weekly hours.
My working week does not include a Tuesday as the service is closed - this is not my choice nor is working 10 hours shift on a Monday but I am dictated by the service needs.
Please help me understand this. Am I just completely wrong here?
    Many Thanks
People love to claim discrimination, but unless this perceived 'discrimination' is unlawful (i.e. is on the basis of some 'protected characteristic' such as gender, race, etc), then it may be infuriating, but it's perfectly legal.

In huge numbers of companies no two people receive the same salary for the same role.  Where do people get the idea that positions carrying a set salary is standard?

I'm sorry but I don't really understand your message AW618. We do receive the same salary, for the exact same role and hours but we work different days that's all. Therefore, I work Mondays and my colleague does not and this is is the basis for my query.
If the days you work are not stipulated in our contracts is it fair to be paid differently?

The legal requirement is that you are paid in accordance with your contract. Whether it's 'fair' or not is irrelevant in legal terms. If you don't like it, you can always raise the matter with HR, but there is no obligation on the company to take any action unless they wish to do so.
