Wrong salary and Nothing being done.

Hi all,

Could I ask for some kind help with an issue I have at work with regards to my salary if possible ?

I recently found out that the position I hold and have done for just over 2 years has a higher salary that what I am being paid and wish to know if there is anything I can do to rectify it or have I simply been misled and have to continue as I am.

I’ll try to keep it as short as possible but factual as best I can.

I have been with the company I work for since 2000, I was self employed working for them until 2015, I became an employee the day after I left self employment for them and began a role for them starting on £26000 basic, we have an annual 2.5% wage rise each year, I missed the first one in the April as I hadn’t completed a full tax year but in 2017 I moved up to £26416 on 01/04/2017, on 18/04/2017 I moved to a new position in the company, didn’t sign anything but began my new role but my salary didn’t change but I did ask in the interview would I receive pay parity with the same fellow employees in the role and was told verbally I would, I found out after 18 months they were on £27000 to start with and each year gained a 2.5% increase.

On my second annual pay rise I went to £27076 which was 6 months before I found out what the basic starting salary was, when I found out I spoke to my manager and he was shocked that I hadn’t been moved to the basic salary to start and said it would be sorted...it hasn’t been, new starters have since been started with zero experience and on the job training by myself but they started on £27500, so already above me yet I’m training them in the exact same job title as myself, on my next annual wage rise I moved to £27753 and I saw this and contacted my manager asking why still have I not been moved to the wage plus annual rises I should have been on, he told me I would “eventually” but that’s neither here nor there and not being the most approachable manager I am now not sure we’re I stand.

I have written down that I believe I should have been started on £27000 and with 2 annual rises should now be on £28366 and have been underpaid by £1183 for the two years and £51.08 for April and £51.08 per month now adding to the £1183 until my salary is rectified.

What would any suggestions be as to what I can do ? My colleagues have suggested to email my manager using the internal email for my company with my reasons why I feel underpaid and if no solution or reason given within 28 days to then contact HR to inform them.

I know this will create a bad reaction from my manager but I feel im getting the mickey taken out of me, the colleague before me in 2016 started on £27000 and new starters in 2018 £27500 so leaving me on £26416 when I started feel like an administration error or perhaps at just 39yrs old but near 20yrs with the company I’m seen as a soft touch and just part of the furniture, I’ve never had any time off or had a disciplinary ever so there’s no reason in my eyes to warrant not paying me what I simply should be on.

What can I do and can I claim for the monies I feel owed for not being placed on the correct salary 2 years ago ?

I’m sorry if I’ve rambled on I just don’t know what to do.

    Not wholely experienced on this, but yes talk to your manager, if no action HR.

    Also it may be worth ringing ACAS for their advice. They will advise you independantly

    As you signed the employment contract not really much you can do other than asking for a payrise.
  • Something similar happened to me, and I pursued it via my manager and hr, the matter was resolved, they adjusted my pay and I got a back payment as well. Just ask the question it'll never go against you and the likelihood is it's just human error��

    Legally speaking youll have been deemed to have accepted the pay youre on by not contesting it sooner. So from a legal standpoint unless it states in your contract otherwise youre paid what youre paid.

    Any decent employer/manager would be more than happy to rectify the problem.

    Mistakes happen all the time in payroll, usually always down to communication issues. Your best chance of getting the money is by being polite factual and almost sheepish in asking. That said you need to be forceful with regards to the facts and whats happened.

    If were honest its probably not worth threatening to quit your job over being underpaid by less than 2% per year. But it depends on how much you like your job really and whether youre particularly principled.

    Good luck, ask away, if the manager says no, there should be no harm in taking it to HR. Line managers more often than not are not too clued up with payroll matters.
  • Thanks for the replies everyone, yes I love my job and the small group of colleagues we have, it’s not something I would quit over but I just feel like I was lied to about the salaries when I asked about them with my manager.

    To me it’s a matter of principal and also if something hasn’t been done properly then I cannot understand why it’s still not been rectified after I made him aware of it, more than likely also an error on my part for not demanding to sign a contract on beginning my new role as I simply it’s started my new role and salary went in the same each month.

    Thanks for your help all, I’ll update if anything changes, I will officially contact my manager via email so their is a paper trail of my communications about my concerns and see what happens.

    Can anyone offer any help?
     work 30 hours per week and am salaried for this. My working week due to service needs includes every Monday of a 10 hour shift so my BH average comes into force.
    My colleague also works 30 hours and is salaried the same. She does not work Mondays and her 10 hours shift is on a Wednesday. This colleague is receives compensation for the Bank holiday as per the BH average.
    I understand that no one should be penalised for not working a Bank Holiday but if the 'worker' has no control over the of the days of the week required to work and receive the same salary, for exactly the same hours per week, month, year - how is this not discriminatory as I am not contracted to work specific days.
    It seems to me that I am being treated differently than my colleague and there is no parity.
    Can it be fair that it comes down to the luck of the drawer which days a worker is required to work despite being salaried for the same weekly hours.
     My working week does not include a Tuesday as the service is closed - this is not my choice nor is working 10 hours shift on a Monday but I am dictated by the service needs.
    Please help me understand this. Am I just completely wrong here?

    I did receive good advice about the initial query regarding Bank Holidays but this is a different point which I am now seeking advice about.
