Claiming surplus rent from council

Scotland also. I have a few hundred in the black on my rent can I claim this back. They said it will be used for council tax arrears yet it's been in the black for months.

    If you don't owe anything to the council then yes. Have you asked them?

    So how big are your council tax arrears?

    What's your total balance with the council, across all accounts and reasons?

    Ah, so when you said "it's been in the black", you don't mean your council tax? If overall you owe money to the council then no, I doubt they're obliged to return it to you. Though not sure why they haven't just transferred it to your council tax account.

    CT arrears are hundreds more than rent surplus which is around £400. Why aren't they just putting the extra rent to CT arrears, why is iit sitting there.


    I could really use the money.

    So, overall, you owe the council?

    They're leaving it in your rent account because that's where you paid it. You can pay less rent to "use" it there, and pay that rent into your CT account, if you really want.

    As for "you could really use it", well... tough. Pay your bills first.
  • I am afraid things are going to be much harder if you start getting charged court fees and bailiffs coming round with their fees because of your council tax arrears.

    Phone the council, ask how the money sitting in your rent account can be applied against council tax arrears. And you really really do need to start reducing the council tax arrears even if you are only paying a small amount each week.

    If you are having problems managing money, go to the debt free wannabe board and ask for their help.

    Perhaps the Council think that, as you are in arrears with your CT, the next thing will be to default on your rent - hence their reason for keeping the money in reserve?
