Rear ended, driver drove off

Hi,
I got rear ended coming home from work last month and i'm a bit confused about the insurance side of things. The driver drove off, but I managed to note down their registration. I told my insurer as soon as I got home and they seemed pretty happy that the other person would be held liable.
The problem now is that my insurer is saying they will not hold them liable for the accident unless they write back to a letter they sent confirming they hit me. This just sounds totally rediculous to me, can anyone confirm that this is correct? Surely all the other person now needs to do is avoid saying anything and they will get away with it.
I have also informed the police, but they have been little help and it's become impossible to even speak to the officer dealing with it.

Our stationary car was hit by a lorry cutting in too close after overtaking us.
We exchanged details and passed the information to our insurance company. We also had photographs of the scene and of the driver and his mate
Our legal cover provided a claims company to handle it.

As time went on we asked the claims company what was happening. They replied that the company who owned the lorry had not reported the accident to them. Nor would they reply to any letters so thier insurance company would not accept the claim against them.
The case eventually went to court for all the costs and a warrant was obtained.0 -
Yes unfortunately if there is no evidence you probably won't get very far. No CCTV in the area?0
