Debt in my name

Hi All probably been covered 1000's of times. My ex has taken a sofa belonging to me, credit agreement in my name.12 months left to pay. Won't speak to me. What can I do legally?

    Small claims court if you think it's worth it.

    He's stolen your sofa.

    Call the Police to enable you to recover it.

    Alternatively, take him to court,

    Not really a Consumer Rights issue.

    Did he still have a key to your place, change the locks if he has.

    Theft. Report the crime to the police and let them deal with it.

    If you were married at the time the sofa was purchased then this will muddy the waters a bit as although the finance agreement is in your name, the sofa will still class as a marital asset. (assuming that you are in England or Wales)
    Matrimonial assets typically include things such as the family home, pensions and savings. It doesn’t really matter who put the money forward or who accumulated the wealth. When you’re married, the law in England and Wales considers that any assets you acquire also belong to your husband or wife.

    If you went through a divorce and the sofa was taken after any settlement then you really need to speak to the divorce solicitor you used (if you had one).
