You need to confirm with your brother exactly what's on offer, bearing in mind that he's not entitled to anywhere near a full refund. If he manages to reject the vehicle the garage are well within their rights to deduct an mount for the usage he's had for the past 2-3 years, which will make the potential VAT refund issue seem insignificant.
