Section 75 claim dragging on!

Hi all,
My fianc! and I are due to be married on 27th December this year. Our original venue went into administration on 4th December 2018.
We had paid 2 deposits at this point, both made on credit cards then paid from savings to give us some protection...
First deposit was £500 paid on a Tesco credit card and the second was £300 paid on a Sainsbury’s credit card. Incidentally, the Sainsbury’s one is fairly new and was taken out only to take advantage of the 0% for wedding purchases!
Anyway...we made claims on both cards as soon as we found out about the company going bust.. Tesco promptly refunded us without any hassle whatsoever. Sainsbury’s has been another story altogether...requesting proof of purchase, then (after a 4 weeks delay!) proof of non-delivery of goods...then they told us they claim needs to come direct from the merchant. The merchant has folded, the business has ceased trading!! We were told to wait again, but assured we would receive our money back by the end of March...
Queue us receiving a letter today from Sainsbury’s stating the merchant has refused the refund...no explanation as to why! But that Sainsbury’s have given it a second attempt. We called Sainsbury’s...apparently we need to wait till mid-May now to see if the were going to get our hard earned money back, or if it’ll continue to line the pockets of some hard nosed hotelier
I am currently 21 weeks pregnant, I just don’t need this extra stress!!!
Can anyone give me hope that we will get our money back, or should we give up??

Tell them you want to make a section 75 claim.
They are currently processing it as a chargeback.0 -

To me its not very clear what Sainsbury's are doing here. This is as easy as a chargeback gets really and the merchant could only refute the claim if they could show they were still going to provide the service.
Asking for proof of purchase is normal but not strictly essential. Saying the claim needs to come directly from the merchant doesn't even make sense.
I suspect your issues are down to terrible service more than anything else
As an aside, no bank would/should need to use S75 for this. Most customers who ask for S75 (near enough everyone) end up with a chargeback where its applicable as this works best for both the customer and the bank (in most cases).0 -

Their card will be cut up as soon as the wedding is over :-)0 -
So it sounds like you made 2 payments towards the same item - a wedding reception package.
Or were the 2 deposits for 2 different items?
If it was just one item, then under s75 you can claim the full amount (£800) back from Tesco bank if you want, and ignore Sainsbury's.0 -

Sainsbury's are still relatively new as far as being a stand alone bank is concerned. Hope you get it sorted in the, im sure you will.0 -

Tesco would request a letter from Sainsbury's confirming the customer hasn't made a claim for the money paid on the Sainsbury's card.
What you are saying is correct but I suspect the OP might be too far into the Sainsbury's claim to make it worthwhile cancelling it all and starting again with Tesco. The option is always there though.0
