eBay OOS items showing as active

Since the change to GTC for items, I have discovered 6 items with zero stock but are still active
I have spoken with eBay who have suggested I manually end the items
Looks like another eBay glitch

The worrying thing is that these are not MVLs, They are single items showing 0 stock.You're only young once, but you can be immature forever

I've never noticed this before and all my listings are GTC.
If they are active, does that mean you will be charged under the new GTC rules ?
Edit : I've gone back through my last 90 days orders and until now all the items that have sold out no longer show on my active listings.You're only young once, but you can be immature forever
