Stamp duty

Hi,

About 5 years ago I was in a relationship and my ex put me as a named person on her mortgage that she already had on her home. I was on the mortgage for a couple of years before we split and I was removed.

I know that the bank I am intending to get a mortgage from now will consider me a first time buyer, but would HMRC see me as a first time buyer aswell and exempt me from stamp duty?

    You are not a first time buyer for the purposes of SDLT if you had any share at all (however small) the property belonging to your ex.

    You would still be a first time buyer if you were jointly liable on the mortgage but never had an interest in the property.

    Thanks. Would that mean if I was not named on the deeds I had no interest in the property?

    It is still possible to have had an interest in the property without being named on the deeds. For example, this can arise through a declaration of trust.
