Blue shaded area on land registry - massive tree

    All the land inside the red line belongs to the neighbour. Looks like the blue part was added to the title at a later date.

    The mines and minerals aren't part of your title, and were split off by separate deeds in respect of the blue and pink bits. It's got nothing to do with the tree though, so ignore the blue and pink colouring.

    As David says, ignore the blue.It relates tomineral rates etc.Nothing to do with the land ownership or the tree.

    Also ignore the fences. Anyone can erect a fence. That does not mean the own the land the fence sits on, or, indeed the land on either side.

    Look at your own Plan and where your (red) boundary is. And where the tree is.

    Look at your neighbour's Plan and where his (red) boundary is. And where the tree is.

    So - is it on your or his land?

    OMG that tree is huge. If it is an oak tree, I would double check there is no TPO on it before doing any work. It needs serious pruning and would be a job for a professional. Also I believe the time for pruning a mature oak would be in the winter (Oct - March) when conditions are cold.

    So the "provision as to light and air" wasn't added to your deeds until a 1976 conveyance - by which time, that tree was well established.
  • Interesting update (hopefully). According to the LR the boundary line should just touch the back corner of the extension on the neighbours property. However, it doesn't ... they have a path down the side (5ft wide). If i mentally draw a line that touches the back corner of their extension, the tree is absolutely fully on our land.

    There is a drop between gardens so it's unlikely whoever built the garage/extension on purpose took the land. The drop means i could never realistically use that 5ft corridor of land.
