Just received a PCN from PE. The driver, overstayed by over 20 minutes in a two hour car park at ASDA. Apparently she was waiting for products near the end of their shelf life to be reduced.

She has handed me a till receipt for 26 items, mainly cakes and deserts totalling less than £15.00.

I am in two minds whether to go for a landowner cancellation or ignore until I receive an LBC where I shall major on signage, see my thread here.

If I go for a landowner cancellation it should be quick and easy, but it will hardly inconvenience PE. If I go to court and win all I am likely to get is peanuts.

What would you do?

    What would you do?
    Appeal with a copy of your Blue Badge & go on about reasonable adjustments, and P/Eye will likely cancel.

    Landowner cancellation, and at the same time kick up as much of a fuss with ASDA as possible, complain to anyone in the chain at ASDA and at the same time, before ASDA spout off about BPA approved operators, codes of practice etc, hammer it home that the BPA are merely a private trade association and the parking industry is completely un regulated, making up its own rules and codes of practice as it sees fit.


    Point them at this as well ( anyone know the outcome of that case??)

    how can ANPR differentiate between blue badge holder and ordinary folk

    I would say that PE have totally failed to take in account of the disability act

    a total failing of one of Asdas employees , and should be dismissed , just as any singular employee would
  • I know for certain that ASDA are extremeley hacked off with Parking Eye.
    They've been removed from our local one.ASDA used the excuse of the shops and flats that are based in the site.
    Go straight to the shop manager.

    I'm backing the landowner cancellation option. I'd imagine they annoy P.E. just a little.

    But if it comes to a fight I'll be watching with interest. Should be a good show!

    I was not in the car CM, I will not lie. My Royal Commission, signed by Her Majesty in her own fair hand, graciously refers to me as "Trusty and Beloved, and in Whom we are Well Pleased", I will not act in a manner to demean that noble accolade.

    If they read this forum they may realise with whom they have crossed paths.

    If theres an equality act issue at play - that is the person required extra time, then an even bigger fuss/issue should be made, as ANPR equipment will not be able to make a reasonable adjustment

    Unfortunately, there is not. As with most other car park users, the driver did not read the signs, which, imo, resemble a contract to build a nuclear power station.

    It looks as though a landowner complaint is likely to cause PE the greatest damage. The store in question has recently parted ways with Smart Parking.

    I attach a parking charge notice from Parking Eye.

    The driver of the vehicle, who is a very frequent customer, was shopping in your store for all of the time. I attach a till receipt for that day.

    I believe that you are aware that this company is doing serious damage to your profits, and that some ASDA stores have severed ties with them.

    However, you may not be aware that on 18th March 2019 a Bill was enacted in Parliament to curb the excesses of private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access.

    I therefore request that you ensure that this invoice is cancelled and reconsider your association with this disreputable company .
