Credit cards while in an iva

Hi all. When I was in an iva I found myself running short and took out 2 credit cards. One with capital one and one with aqua. My iva is now complete and I have my certificate but obviously still have these 2 credit cards. The aqua one in particular is quite troublesome with it's high apr. Do credit card companies have a duty of care NOT to give credit to people in an iva? With that in mind can I get these card balances wiped out as they shouldn't have let me take them out.? I appreciate I was an idiot and shouldn't have got them but needs must at the time.

Ignoring the fact that you are trying to take as little responsibility for your own decisions as possible, what were the original credit limits on the cards?
By taking out additional credit whilst in an IVA I think you have shown that you have failed to address the habits that got you in to the situation in the first place.0 -

If the information on your application was all correct then you might have a case for irresponsible lending given your circumstances, but if you gave inflated facts at any point on the application then you won’t have a case due to misrepresenting your circumstances.0

i took out a credit card 12 months into my IVA, to start repair work on my file, and another one 12 months after that. Aqua and Vanquis.
but, i learnt from my past. i still have both cards, and apart from paying a few pennies interest for an emergency a few years back when abroad, never racked up any further debt on them at all. use them as intended by paying off in full each month0 -

there is no case for irresponsible lending, regardless if application was correct or not. I assume it was correct, as cards like these do offer people on bankruptcy, IVA, poor histories etc the chance to rebuild. thats what they are designed to do. Under an IVA, you can take credit for up to £500 only. these cards would have started with a low £200 limit0 -

So, why would you now try and wriggle out of paying up? Paying it off will improve your credit worthiness. It's not just good for your credit, it's the right thing to do. Pay up. If you can't afford credit, don't take it out. Simples.0
