Returned car on finance, been 3 weeks and dealer has not returned the money...What to do?
Hi,
I purchased a new car on finance at the end of feb, cut a long story short had one issue after the other one part of which was a replacement engine and gearbox..This car was only a 2014 ford focus with 40k miles on. After countless visits to the dealers to get this fixed they said it was all ok. Drove home and the car sounded terrible and over heated. Mechanic visited my home while i was at work and said fixed the issue, a coolent pipe had popped off. On my return my partner informed me he did not test drive it......so i did...still a loud noise..phoned dealer again and said mechanic would be out again next day...didnt appear the next day so by this time i had decided to use my rights and return the car..Had the car for around 4 actual days of the nearly 4 weeks i had it..mechanic did come next day and said exhaust had blown by the engine. Dealer refused to collect the car insisting he could not do this untill end of week and sooner i returned it the finance would be returned etc..He accepted to take the car back and didnt argue.
Now 3 weeks later the finance has still not been retuned to the brooker or the finance company and have already made a payment on a car i dont even own. I spoke to the dealer 3 times and each time promised to send the money back and even said he had sold the car saturday just gone and did not want to use his own cash to refund..its not his own cash! car was re sold saturday and assured me funds would be returned monday..now thursday and nothing still...sick of taking to broker and dealer...think the broker have escalated it but been 3 weeks without a car and unable to finance a new one due to this.. luckly i had kept my old car or be up the creek....
Can i do anything or do i just have to leave it to the broker and finance company

Your next step is a letter before action, then take him to court. <£10k, so it's small claim.0

Contact the finance company directly. Don't rely on someone else doing it. Explain to them that the car has been returned. Tell them that you want all further payments cancelled, and you want a refund of everything you have paid so far.
You have rights against the finance company under section 75 of the Consumer credit Act. They are jointly liable along with the garage. If it sticks, force it.
If it breaks, well it wasn't working right anyway.0
