    My insurer have indeed washed their hands of it. I have raised a complaint with them and to the financial ombudsman to see if this can get them involved.

    I think, as mentioned, Im stuffed in regards to the invoice from Enterprise, but Im wondering if I have a case to claim compensation for the misinformation and lack of due process in the referral.

    I totally agree... where they get the car repaired is entirely nothing to do with me and whether it is appropriate or not... but... I'm just questioning the wording of their terms... they said they'd charge for a fair market value. How can that not include an average of repairs from a cross section of the market? Im not talking about some dodgy bodyshop, but if the repair is to a standard where the car is as it was prior to the accident, then I don't understand the issue. Is the process just in place to extort money or is it in place to make a loss good again?
    I know Im being pedantic, but if there's some possibility of reduction then I'll take it!

    In the meantime I would explain to Enterprise that you can't pay it in full and see what happens. If it were to go to court it's possible a judge would award you a rather lenient repayment schedule. Enterprise may well know that and be willing to compromise on the sum or the length of time you have to pay.

    What they mean been by fair market value is that they think its a fair quote in regards to the damage, its terminology used to make it seem less impacting on a person on its receiving end in the hopes there will be no dispute of its cost.


    You have to exhaust all complaints avenues and processes with Enterprise BEFORE you can get the Ombudmans attention, doing so prematurely will only result in a letter stating cant do nothing at this stage, you must have a letter from enterprise saying they no longer willing to look at the matter or request a dealock letter before proceeding to the Ombudsman.


    Its standard practice not to cover named drivers with hire cars and courtesy cars, your wife would not have been covered by a courtesy car or hire car in this case, as its for the use of the main policy holder only. If they were to allow it, she would have to go the processes you did with your licence and national insurance number and sign the hire agreement, and sign the insurance cover.
    You signed the contract and this is deemed you were/are aware of the terms and conditions, your wifes use of the vehicle is outside of the terms and conditoins of the hire agreement, so refer to this terms and conditions of liability in the contract of what expenses you will be liable for.


    You will also have to notify your insurers who your wife is a named driver and notify them of her incident if you have not already.


    If you cant come to some sort of repayment option, Enterprise can take you to court for a liability order, Enterprise are known for then getting a high court writ on the judgment for High court enforcement if a previous payment option or plan was not adhered to.
