  • I did copy my Witness Statement from Microsoft Word so that must be the reason I got blocked than.

    One more question.
    How does the Cost schedule looks like,is there a certain form to fill in? What is considered reasonable to include?

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Or search the forum for costs schedule £300 to see one that argues separately for punitive costs on the indemnity basis, if you are confident enough to read out what you consider to be evidence of the PPC's unreasonable conduct.

    Hi all,
    Just wanted to post an update. I've received a Witness Statement from Gladstones Solicitors.
    Seems like their Client is not attending the hearing.
    "The assumption is that our Client is not attending the hearing and therefore we kindly request this notice be treated as a notice pursuant to CPR 27.9. However on some occasions our Client may wish to attend and will do so."

    There is a paragraph in the witness statement that I haven't seen before and wanted to see what you all think about.
    "Internet Defence
    My company would like the Court to note that the Defendant is using a generic defence which can be found on the internet and it is highly doubtful that the Defendant would understand the complexities of all the references to the Civil Procedure Rules,the requirements in the Protection and Freedom Act(POFA)and in established case law,which often the case when a Defendant is questioned about such references at Court. Therefore,everything that the Defendant has outlined is not accepted and denied by my Company."

    Just because it's an "Internet" defence (whatever one of those is) doesn't mean it is wrong, nor that it is unlikely to win in court. Best way to deal with it is to turn up at court with an understanding of CPR (easy enough to find by asking Auntie Google) and of POFA and then stand back and wait for their representative (who has declared may not turn up) to ask you questions.
