PCN help

I’ve just been made aware of an outstanding fine that my other half got in 2017 as I have received an LBC as registered keeper. I have requested the SAR and received all the paperwork & photos. My other half decided to park in a permit only private car park underneath the parking sign as they needed to go to the toilet urgently. I think the parking company has complied with everything they need although they have missed off my flat number from my address. I would like advice on what to do next? Do I pay up, give the drivers name or appeal saying that the address is incorrect.

The dates of letters are:

PCN 20/9/17
NTK 25/10/17
NTK2 27/11/17
Final Reminder 12/12/17
Legal Action 27/12/17
LBC 11/02/19

    Which parking firm?

    Who is the LBC from (solicitor?) and does it give 30 days to respond?

    How come you never got the NTK in the post, have you moved? Have they only now used a new address? If so, it is VITAL to confirm the 'address for service' to the sender of the LBC and tell them to ERASE the old address data (and tell the parking firm too).
    I have requested the SAR and received all the paperwork & photos.
    How many minutes did they take photos over, exactly? Less than ten means they gave no grace period for a driver to read the signs.

    Most PCNs are appealable and you'd be MAD to pay some daft 3 figure sum just to avoid paying a similar sum or less, if you were one of the few here who lost at a hearing.

    The parking firm might not even be able to hold you liable so don't rush to name the driver till you've told us which PPC this was & answered the questions above.

    Thank you for replying and here are the replies to your questions.

    The LBC came direct from SIP Parking and they did say 30 days to respond.
    I never received the NTK as the other half intercepted all the letters & thought it would go away!
    There were 13 minutes between being seen and ticket being issued. Plus they parked directly in front of the SIP sign so this is why I thought it may not be worth appealing but given the fact they were in a desperate rush & weren’t looking for signs maybe it is.

    Complain to your MP. On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    the time for appealing has long since passed

    this is an LoC (LBC) , a legal requirement before court action commences against you

    at this moment in time you have no avenue to appeal

    its EITHER pay up in full, or fight

    if you choose the latter , you do the SAR by email to the DPO at SIP and then await court papers from the CCBC in Northampton

    Ok I’ll have to think about it as I really don’t want to pay them the charges but my other half was stupid enough to park right in front of the sign! & then ignore the letters! Thx for all your advice.
