End of tenancy help

Hello

I hope this is in the right place.

I recently came to the end of a six month tenancy on a property as a tenant. I advised my landlord with the correct notice period etc. He advised by email that he had a new tenant lined up for the property, however, she needed to move in a week early (which would have been my last week as a tenant) he emailed and asked if i'd be prepared to leave the property early and receive a refund of one weeks rent as the new tenant will have moved in. I checked out and returned keys etc under joint agreement with landlord that I would end the tenancy early.

I queried when I should expect this refund as this was now a few weeks ago, landlord replied by email again stating tenant had pulled out at last minute and thus no refund is eligible. Should I chase this refund or would I have no hope of legally recovering the refund? It;s about £230 so not really lose change for me.

    What exactly have you got in writing from the LL?

  • Everything via email. He sent an email outlining how much I would be refunded and again outlining the reasons he wanted to end the tenancy. i.e. getting a new tenant to move in, who would need to move in a week earlier than the property being available.

  • I'm not sure I can be more specific.

    Three emails in total:
    1 asking if i'd be willing to vacate property early to allow a new tenant to move in and thus receive a refund for one weeks rent.
    2. Landlord advising how to return the keys and check out (date given as one week early that contracted)
    3. Final email as a reply to my query asking when I should expect the refund. In his reply he said I shouldn't expect a refund as the tenant pulled out at the last minute.

    This is horribly familiar! In my last rental, I was asked by the letting agent to move out 1 month early as the property was being sold, which I did. Then as the completion date was delayed by 4 weeks I was expected to pay almost a whole months rent after I had moved out. The agent point blank denied asking me to move out.


    I ended up appealing to the Ombudsman and was awarded a token £100 compensation, even though I was over £800 out of pocket.


    The difference in your case is that you have this in writing, all of my negotiations were done over the phone (a big lesson learned).


    I am sure G_M will be able to give you the right advice, but it might be helpful if you clarify if there was an agent involved or if you rented direct from the landlord?

    not on the informaion provided so far!

    but it might be helpful if you clarify if there was an agent involved or if you rented direct from the landlord?
    It would make no difference whether an agent was involved or not.


    Nor whether the emails came from the LL or an agent.
