"Marked" bay

Hi,
I am currently awaiting the debt collection letters to start arriving and have been reading your threads in order to defend myself if any court action is taken.
My question is this.... if the bay I was parked in only has "marked" lines on the left and right of the bay and no "marks" indicating the front and back of the bay can they say the kerb is the start of the bay as it's not painted?
I have a long wheelbase van which I park at a local mc Donald's for lunch (and have done many times). I always put the front end up on the grass verge over the kerb so the rear doesn't stick out into the road. As it's grass and not interfering with any other bays I'm not restricting any other parking, I was parked perfectly between the lines so I was only taking up 1 parking space.
I got a ticket through about a month after saying I was parked outside the marked bay. I've gone through the appeals and obviously lost them as expected, unfortunately I didn't seek any advice before this stage.
So my main defence is the wording on the parking sign, referring to "marked" bay.
Do you think I'm right or flogging a dead horse?

Yes I certainly will be following advice on your other threads going forward, I was just looking for the best way to defend if it does go to court and couldn't find other threads with the same circumstances, all other marked bay issues I've found were people over the lines0

You are not dealing with real parking laws or regulations, you are dealing with an alleged contract with the owner of a private piece of land where they allowed you to park subject to their rules.
It's pretty tatty and annoying when vehicles are parked on landscaped areas designed and tended to at least attempt to make a retail area seem more appealing.
However whether that infringes the contract they say you broke by your assumption it was fine to leave an oversized vehicle on their greenery only a judge can decide for sure, and that's a bit of a lottery.0 -
I agree with you, but I am not a judge, let him/her decide. Meanwhile, complain to your MP, who will very likely be firmly on your side.
On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.
Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0
