Help with premier guarantee

Hello

I have a problem with my joist in my new build shared ownership property, I reported these issues within the one year defect period which has now passed. They have tried to rectify it and have had no success

Both the builder and housing association have now said I need to contact the insurance to get an independent assessment. The excess could be £1000 which i would have to pay but I don't see why I should seeing as it was reported well within time frame??

Should I still go to the insurance or complain more to the housing association and get it fixed outside of the insurance?

Any advice?

    Are you sure it's only a one year period, usually it's 2 years on new builds. Premier Guarantee say...
    During the first two years of cover the Developer is responsible for remedying defects

    Does the builder agree that the rectification is unsuccessful, or is that your assessment?

    It would be strange for the builder to walk away, if they agreed that they hadn't fixed the problem.

    Are you sure that the builder isn't saying that they think it's fixed, and if you don't agree, you need to get an independent assessment.

    If that is the case, I guess you need to agree who pays for the independent assessment.

    Basically when the builder has attempted to fix the problem it has short term success.

    They have done this about 4 times and the problem always returns.

    They are saying they have no idea how to fix it so I said maybe I need to get an independent view. Both the builder and housing association then agreed that insurance claim is the best way forward

    This makes me think one of 2 things

    1. They know its a bigger problem that they are letting on so are either calling my bluff and want me to fund the excess

    2 They know how to fix it but don't think a claim will be successful so are not bothered.

    The initial defect period is one year according to my insurance details I have. The remaining 9 are structual only.

    My annoyance is that this was reported to the housing association within that period, but I don't know if premier will honour this as they have only been informed on the problem after the period has ended.

    What is the nature of the problem?

    As I say, a sensible way forward would be for you to get specialist to inspect, and advise on what work needs doing. (The specialist would probably be a building surveyor - but it depends on what the problem is.)

    And agree with the builder that they will cover the cost.

    To me, that just sounds like a fob off - "I don't want you to bother me any more, so contact the insurance company and bother them instead"

    The insurance company will ask you when the problem emerged - you'll say in year 1, and they'll say "Talk to the builder".

    Yeah I agree that it sounds like a fob off. It's really annoyed me to be honest because I feel now the 1 year is over they are not interested.

    My next step was going to be emailing the housing association and saying I have noticed that premier guarantee has a 1000 excess and I am unwilling to pay this as the problem was within the 1st year, can they confirm if this would be covered by the builder and if not the builder must try again to fix the problem

    As you reported the problem and they acknowledged it with in the correct timescale they would remain liable, that's how a warranty tends to work.
