Tenancy Renewal June 19

Am just about to enter into my fifth year as a tenant with the tenancy due for renewal on the 1st June 2019. I rent through an agent. I have seen various articles regarding law's being changed regarding the charging of fees with these coming into effect on 1st June. As an existing tenant, does the law change still apply to me?
I would like to know before I challenge the letting agency,
Many thanks in advance.

Why do you need to renew at all? Just let the tenancy you currently have continue - it would be a daft LL who decides to get rid of a tenant of long standing because of that.

yes the changes will apply to you, any tenancy that is renewed after the 1st June will be subject to the new legislation. The agency could ask you to sign now and pay a fee, this would be in breach as the new tenancy wouldn't start till the 1st

The MSE article at least suggests only tenancy agreements SIGNED after 1 June 2019 would be in scope for the fees ban. So if you sign now for a fixed term to start 1st June, then they could still legitimately charge fees.

OF course you could refuse to sign unless they either agree to 0 fees or wait until 1st June. However they wouldn't be in breach of anything if you don't insist on one of those and still sign today.
  • Thank you for all the information and clarification.
Forewarned and forearmed I entered into a conversation with the letting agency.
Initial response was no, fees will be due, but when I challenged them using the knowledge gained from your postings they have backed down.
    Thank you all!
