Britannia Parking PCN

I’ve received a PCN from Britannia parking through the post today I’ve read the newbie FAQs but am a little confused sorry!
Is the advice to ignore this or appeal using the below?

Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

- If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

- If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

- in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

    Complain to your MP. On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    Send the already written for you blue text template appeal that you will find in post #1 of the NEWBIES FAQ sticky thread.

    Send it unchanged - no additions or alterations needed.

    Send it as the keeper.

    Why are you confused? Is there anything in that NEWBIES thread about ignoring a PCN?

    The advice is clear.

    Pleeeeease spare us...no-one copies the template appeal here and asks 'do I send this?'

    Why not tell us something about the car park/contravention in readiness for POPLA stage where you will need help?

    And tell us what happened when you complained to the landowner/retailer?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I am confused as the newbie thread advises to send what I have copied above howvefe when reading forums of a similar nature conflicting advice is given, as you can see from this thread I have been advised to complain to my MP in one instance and send an appeal from the Newbie FAQ in another? Not sure why it’s necessary to make people feel stupid about clarifying information????

    Sorry, can't comment on 'forums of a similar nature'.

    I said to send the blue template appeal from the NEWBIES thread because I wasn't going to compare word for word what you had pasted with the NEWBIES template to see if that was what you had pasted.

    Why can't you send the initial appeal and complain to your MP?

    And, as also mentioned, complain to the landowner at the same time.

    It is necessary! The experienced regulars work like trojans. Let it go 'cos if things get more complicated down the line you'll be in safe hands here .... unless the aforementioned trojans have been exhausted by us newbies saying the same things again & again!

    Good luck with your appeal. Complaining to your MP is a good idea if we're to keep up the pressure on the government / get them on side. And a prompt landowner complaint, if relevant, is an excellent idea too.
