EE cancelling my contract, can I keep the phone?

Hi,

Hoping for a bit of advice.

I took a phone contract out with affordable mobiles (third party company) on EE with a free phone. 10 month later EE have agreed to cancel my contract without any fees due to me having network issues and not being able to make calls sometimes.

They have said via email that they will only cancel the contract if I return the phone but as I told them they didn't supply me the phone affordable mobiles did.. affordable say I should return the phone to them but since the phone was free and its my network cancelling the contract early do I legally have to return the phone?

If they are saying the phone is part of the contract then surely at a minimum I should get a partial refund for the amount I have paid towards the phone over the past 10 month..

Does anyone have any info on this subject or advice?
