NIP forecasting undue dazzle

I'm looking for advice for my sone who was stopped by the police and told he was going to be prosecuted for causing undue dazzle/discomfort. It was a little foggy so my son was using his fog lights/high beam. Others were doing same as shown on his dash cam footage.

Thing is he was given a verbal and a ticket written( is that a NIP too) and told there would be a NIP in post within 14 days. It has just been received with the offence been noted as on 6/2/19 but the notice issue date is 27/3/19

Am I right in thinking that it's outwith the 14 days? And what should he do if it is?
Also if it still holds I think this was an over zealous prosecution should he appeal and use his dash cam footage. He's a young but very sensible driver so I'm annoyed he's going to be penalised for this. Especially just before he was pulled over someone was raking up the motorway, tailed gated him, over took and freaked hard in front of him then sped off. Maybe too much effort for the officers to pursue as my son was an easier target - just personal annoyance being voiced.

    Maybe the officer is right.

    If it is bad enough to use fog lights you would not use high beam. It's either or. (You will see more in thick fog with no lights than you would with a high beam as high beam just gives you a white wall in front of you. Fog lights are designed to penetrate the fog) And fog or no fog you would not use high beam in the face of oncoming vehicles.

    I have never had anyone freak hard in front of me. It must be an interesting experience. Either way, neither of these facts are relevant in terms of a defence.

    As he was stopped at the roadside no. The 14-day limit is irrelevant.

    You said fog lights/high beam in your OP.....they are different things. As has been said you don't use full beam when foggy.

    Dash cam footage of other drivers wont help his case.

    Exactly this! I have in some rare times that these is dense fog I have turned off my dimmed main beam as it just made things worse. And I am talking dipped beam not full. Anyone using full beams in fog should be disqualified.
