Hello there.
Yes I have read the NEWBIES Thread !
Yes I've done lots of searches for similar cases..
It is very helpful but I've lost count of how many time I've gone through it but I still can't decide what to do. I will keep it as brief as possible as I know it is a busy forum.
Premier Parking Solutions of Newton Abbot Devon
My partner parked her car for 2 minutes in an access road to a private car park, not blocking anything or using anyone's space and no ground markings. In the time she was away a parking attendant watched her leave her car from his own vehicle and within the time she returned a Parking Charge Notice was affixed to her screen.
He could have easily told her not to park there but didn't.
Signs all clear and plentiful but she was in a rush and didn't register them at the time.
This all happened last Summer and I have only today found out about it as she has been hiding the letters from me.
A notice to keeper was sent and ignored followed by another in January again ignored. No contact has been made , no appeals or any driver information divulged.
Today a Notice of Action was received and has got her very worried and just wants to pay the £100 + £30 admin fee for late payment.
Bang to rights ? or do I wait for court letter? .I would much rather give the £130 to charity if anyone could help or point me in the right direction.
Thanks

2 choices , pay in full, or fight back
if you both choose the latter, the keeper sends a SAR to PPS to their DPO by email to get all the data they hold on the keeper and vehicle
after that , you can expect the keeper to receive a court claim form (N1) from the CCBC in Northampton, in which case this is acknowledged and defended , partly with the grace periods aspect + predatory tactics being used, so download and read the relevant CoP ( BPA or IPC)
then its all down to the resolve in letting a judge decide in your local court
nobody here will advise you or her on which action to take, its a matter for yourselves
what we will do is outline the options so you can make an informed decision
you can come back to this thread if a court claim form arrives, they have 6 years to try court0 -
Thanks Redx, the help is really appreciated . I will do some further research as I don't intend paying them if I can !!0
