    I think it is now time to see a solicitor.

    Perhaps a letter from your solicitor might help things along.

    The letter doesn't need to be aggressive. It simply needs to explain your view of her legal position, and ask for her to leave the property within a period of time which you are happy to discuss, tell her that she should seek legal advice if she is unsure of her position, and explain that you will have to go to court if she does not cooperate.

    Thank you so much, this is great advice. I will write a letter doing as you suggested and officially give notice.
    That is a good point about the reason for not releasing the paperwork..she kept saying things are “private” and not our business but obviously it is now.
    Definitely, not going to be aggressive, we had a friendly relationship before my dad died so it’s really odd that she’s turned like this. I like the idea of the reduced sale. We’d be happy to sell to her, both myself and my brother own houses in different parts of the country so have no interest in living there.
    She definitely won’t be homeless, the funny thing is is that her house that she owns is round the corner!

    Nope, it’s highly unlikely her property is sold. I saw them a few weeks before my dad died and she was telling me all about her tenant lol. It’s so odd!

    Maybe she just wants to stay in the house where she has her memories of your Dad, nothing really odd in that (although I see from your side that she can't).


    The suggestion further up about offering to sell to her seems a good one, she might be assuming you want the house back for either of you to live in yourself.

    Well, if she likes the house so much, why not sell her own and buy your late father's property from his heirs?

    Yes I think that’s probably the case. I do feel for her as it was her home for many years but it was our family home before that. The lesson here is to make sure you have a will and agree things in life

    To be fair to the lady currently in the house she has no idea at this stage if this is even an option, although I agree it is her fault she doesn't know this by refusing to engage.


    The OP has done nothing wrong but grief can make people act in ways they wouldn't normally, the OP is grieving as well and the lady needs to reconise this, its a sad situation.

    Don't forget the tenant in her house may well have a contract giving them rights to stay in the house for several more months and may not be in any hurry to leave even if issued a S21 themselves.
