Rent arrears and bank failed recall

This is a long one so I apologise.

We have basically paid our rent money into the wrong account (banking details supplied by housing association, I believe not be ours or banks error with bank details). So since Oct 2018 they have not received our rent. Mid Feb they contact us to tell us with we are nearly £4000 in arrears. I’ve contacted my bank and sent proof we have been paying etc, landlords then agreed to no further action whilst my bank put a recall into the receiving bank. The receiving bank have not heard from their account holder and so are unable to process a recall. My bank are now unable to do anything, I can not contact the receiving bank as I’m not a customer of theirs, the financial ombudsman can’t do anything for me in getting my money back as I’m not a customer of the receiving bank, the CAB don’t know what more I can do but are looking into things and will hopefully be in contact at some point next week should they be able to find any other avenue for me.

Has anyone been in this situation in regards to a failed recall? Does anyone have any knowledge on where I go next? Any advise would be greatly received.

    If the HA supplied the bank details - sort code and account number - where you have been paying your rent, then you have been making your payments as instructed in good faith, so how can they say you are in arrears?

    This is for the HA to sort, not you I would have thought.

    It also has to be asked - why did they allow £4000 of "arrears" to build up before they noticed?

    There are two separate issues here.



    1) You paid using the details supplied by the HA, if those details were wrong the fault lies entirely with them. You must insist that they credit the payments that you made in good faith to your rental account so that there are no arrears.


    2) For recovering the money paid to the incorrect account, as G_M says that's something that can be covered on the banking board, but if you can't get the money back then it's the HA that has to be out of pocket, not you.

    Were the bank details supplied by the housing association, or did someone pretending to be the housing association send you an email with the "new" bank details? That'll make a difference as to whether the HA or you are culpable.

    You don't sound entirely sure about this. Have the payments been made to the account details provided by the HA?
  • No they were silupied over the phone by the HA

    So you have no proof that they supplied you with the wrong details?
    I think it would require you claiming from the recipient but not sure how you will do that unless you have been given their details.
