grrrr! bought U2 tickets on ebay, wrong date on tickets!!

    I can't see what isn't fair about the situation. Yes it is really unfortunate but if your sister had been really worried she could have slapped in a protective paypal chargeback just before the time limit expired.

    Ebay warn about not buying things that are not in hand, they will probably just point to their own advice on that one.

    Have you thought about the fan club, maybe they can help put you in touch with someone willing to swap?

    Sorry, forgot to say about the tickets not being available until just before the gig. I think this bit is genuine, I saw mention of this on a web group about tickets in general. To try and stop the huge amounts of illegal touting going on tickets are now often despatched to the purchaser close to the time of the gig so they can't be sold on easily.

    The sale of tickets on ebay is a real grey area anyway as they are rarely transferable , again this is an anti touting measure. Many ticket auctions rarely get to finish as they are reported and removed by ebay. The U2 ones in particular were supposedly shut down entirely, although the day I saw that in the Guardian there were still dozens of live auctions!

    Actually the sale of items not in hand is okay by ebay under certain circumstances including in the case of concert tickets:

    so going on those rules, ebay does make exceptions for tickets that are not available until after the sale has completed

    looks like ebay should be helping here then?

    No, the small print of the rules say

    "A seller who lists a "pre-sale" item on eBay must clearly indicate within the listing the fact that the item is a pre-sale item and a delivery date that indicates the item will be shipped by the 30th day from the date of purchase. Additionally, this text must be HTML font size 3 (at a minimum.) eBay will end any listing that is a pre-sale, which does not include this information.

    eBay, at it's discretion, for special promotional events, may approve a 1st party manufacturer to sell an item outside of the 30 day Pre-Sale guideline so long as the 1st party manufacturer is supplying the actual item for sale. These exceptions will be made for certain promotions and must be approved by eBay in writing prior to listing items for sale that fit the exception above."

    So I would assume that an unlicensed seller of tickets wouldn't have written agreement from ebay to trade in them and act outside the 30 day rule in the first paragraph.

    the listing didn't say anything about not having the tickets to hand, and they were posted around 70 days after the auction ended. she's emailed me back and says she thinks her friend has the tuesday tickets so she'll ask her and get back to me. i don't think she's scamming me, she seems genuine. but my sister has gone mad and has rearranged everything today anyway, she's rearranged the childcare at no extra cost and they both managed to change their days off work, the only thing she lost out on is the hotel on the tuesday night, so now it's all arranged. what's the betting the seller NEEDS the wednesday tickets now and i'm going to make things inconvenient for her by saying i'll keep what she sent me lol! sis is still out of pocket but in fairness the seller has been at work all day and couldn't have known what was going on while my sis was getting irate and phoning round like mad to rearrange everything.
