After a few months, I thought an update was in order:
1) CEL sent registered documents to an address they dreamt up out of nowhere. It was a combination of old and new, and clearly I didn't live there. They then finally had the courtesy to mail me the relevant documentation, which showed that they had prepared a defence and planned on attending the court hearing. Part of the claim was costs, and asking the judge to award in their favour as I was claiming exorbitant amounts.
2) I phoned the court and they confirmed that CEL had paid the £55 fee, and had submitted the relevant documentation in time.
This meant that I either had to default on the court date, or spend a considerable amount of money flying from South Africa to UK to attend the court case.
I opted against the advice given here, and decided to settle with them. This cost me only £100, and neither of us had to attend court. The judgement is finally off my record, and I am free from these cockroaches.
Whilst I would've loved to take this all the way, my time was worth more than what the settlement was.
I would like to express my utmost gratitude to everyone who helped, but especially Coupon-Mad. This was the most stressful thing ever, and saw me literally leave the UK because we couldn't buy a home!2 -
This was the most stressful thing ever, and saw me literally leave the UK because we couldn't buy a home! That is terrible!
The court hearing woud have been by telephone though, if it was within the last 10 weeks. You would have won or CEL would have discontinued. You also didn't get your £255 back which is a shame, but at least the CCJ is gone and we were glad to help.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
