Britannia/BW Legal court claim defense for comment
Comments

What is the exact name of the claimant?0
-
As on the DQ letter, top right hand corner -
'Claimant - Britannia Parking Group Limited T/a Britannia Parking'0 -
What about on the claim?
And what about on the PCN?
There is a reason why we are asking. Read the thread by avem1 (NO LINK GIVEN to newbies as we encourage everyone to use the forum search, or the members' list).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, OK read that thread.
If I'm right, the judge found in favour of the Defendant straight off, due to the company claiming against them being inactive.
Various registered numbers on my paperwork -
PCN - 0818990 (Search result on Companies House website says - 'No results found'.
Final Reminder - 08128990 (Search result - Arabian Eagle Limited - Dissolved 2014. The '2' looks like a slightly different font, so probably a typo).
Letter after POPLA appeal - 08182990 (Search result - Britannia Parking Group Limited - Active).
They seem to have an outstanding 'charge' but following that thread I didn't read anything about it stopping them trading.
The named directors seem to have about a million different companies registered with roughly the same name!?
It may also be of interest on the BW Legal paperwork the client company name changes from 'Britannia Parking Group Limited t/a Britannia Parking' to just plain old 'Britannia Parking Limited'.
Man, I have no interest in knowing this much about this company.
I'll look now at filing in the DQ as per other links.0 -
'Britannia Parking Limited'.
This will help you at WS stage, to paint the clear picture that the 'Claimant' didn't actually issue the PCN, or the paperwork that followed (or only some of it) and as such they failed to serve a valid PCN at all or establish themselves as the 'creditor' as required by the POFA 2012 and the BPA CoP.PRIVATE 'PCN'? OK fired off my DQ, filled in as per the Court Claim Procedure thread.
One to the Northampton court and one to BW (I redacted my current address and mobile phone number from the BW one, hope that's not too naughty, I just don't trust them).
I had a lousy reply from the Ombudsman after writing to them about Britannia presenting POPLA with a totally different case for evidence of mine.
'I am satisfied that the assessor was able to view this document as she has stated the reason for the PCN issue'
The document from Britannia stated I was at a Morissons car park, not the multistory I visited, so how this satisfies them I have no idea.
Equally useless reply to my e-mail to the BPA - 'our Code of Practice does not cover payment machinery' ? Great, cheers for not sitting on the fence guys.
Happy to share more if it interests, otherwise I'll wait to hear from the courts and probably contact the local paper in the meantime.0 -

You definitely want BWL to know you current address, or are you looking forward to getting a default judgment against you?
Seems to me that the only Britannia cases getting through to a hearing are those that are undefended (for whatever reason, including incorrect or not known addresses).
@OP - why have you redacted your current address?
If you receive a Judgment in Default, you will have one holy mess to sort out that makes the work in currently defending this look like a walk in the park, and it will cost you at least £255.
And whatever you do, don't cross the line of the court considering your actions 'unreasonable', otherwise you could ship serious additional costs. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi,
OK I take your points.
r.e. address, I am staying temporarily at a rented house whilst working a contract in the area, last thing I want is a trail of junk mail arriving for the owners after I leave.
BW have a valid address for me which I can be contacted through.
They also have my e-mail and home phone number (which they haven't been shy of phoning), getting junk phone calls is also something I want to avoid.0 -
OK I've been a good boy and sent a second unredacted copy to BW yesterday.0
