    Was you car ever registered at your old address or has it always been at your parent's address? If it was never registered at your old address, I would say you have good grounds for a set-aside. However, how did the PPC get hold of your old address if your car was never registered there?

    My car as always been registered at my parents address and never has been registered at my old address. I don't know how they got that address I guess that's a question to ask Britannia parking as they handed over the details to bw legal
  • bw have used a rather bad tracking service , the fact that this has happened , and you possible producing documentation to show v5 with dates on it would be a good ground to start with

    BW have not used due diligence

    you will state that you want his setting aside and you will fight the actual case in court should they wish to proceed

    Where are posters finding this ancient and hopeless paragraph? REMOVE IT:
    2.5.2. No Loss Suffered by Claimant: Their claim is presumably based on damages for alleged breach of contract. It is a fundamental principle of English Law that a party who suffers damages through breach of contract can only seek through court action to be put back in the same position as they would have been if the breach had not occurred. In order to do so, they must demonstrate their actual, or genuine, pre-estimate of loss. I submit that no loss has been suffered by the Claimant as a result of any alleged breaches of contract on the part of any motorist of the vehicle of which I am the Registered Keeper. I further submit that any loss to the landholder (which would be the only party able to claim such losses) would be at most a few pounds.

    Do you qualify for help with court fees to avoid paying £255? Check online!

    I'm going to ask for it to be set aside as I never received the claim and dw legal failed any due diligence.

    Would it be worth sending a SAR to Britannia?

    100% yes, send a SAR to Britannia, BW Legal and DVLA to see who holds what on you. Their Data Protection Officer emails are all on their privacy policy pages. Send it by email, and send it today. They all have 30 days in which to respond. DVLA is the only one who will acknowledge by post.
