Hi
My OH has been told that his job is at risk and is going through the first consultation. Lots of people are at different stages as they were all told at different times.
Anyway someone who is further along the process and had an interview for their job and they were unsuccessful and told him that they have to give 3 months notice. I didn't think this is how it works. I thought there was a time limit for this and the employer made them redundant within a certain amount of time and the employee wasn't expected to give notice. After all the employee isn't leaving in the same the would if they were leaving to work elsewhere.
Have l got it wrong? I am so confused and don't this on top of the rest of the process.

If your OH is made redundant, then they are entitled to redundancy pay if they have been working for their employer for 2 years or more (unless their company has enhanced terms) and they are entitled to notice. It is the company making him redundant, in effect dismissing him, so it's them giving notice.
In terms of notice, this is either worked or paid to them as part of the package as pay in lieu of notice. This is at company discretion.
After 2 years the entitlement is either 1 week per year of service up to a maximum of 12 weeks (as a statutory minimum) or more than that if their contract specifies more. So it really depends on the individuals terms and circumstances.

Thank you for your reply. Everything seems to be in pickle at the moment and it is all being done a few here and few here so everyone is at different stages of the process. OH only found out a few weeks ago (about a months after others in his office and he thought his job was safe but alas this is not the case). It is all down to restructuring and lots of people who have done the job well for years are not getting any of the jobs they have applied for so it is all a bit of a mess. But these are the time we live in jobs are no longer for live and there is no loyalty on either side.Stash Busting Challenge 2016 6/520
