Blue badge UKCPS

BB2019
I received a NTK within 6 days of parking in a disabled bay without a blue badge last month while visiting the cinema.
My blue badge is always on the dash. Im a regular patron of the cinema for the past so many years and its unfortunate that is incident occurred. But it wasn't out of taking advantage of the bay or anything. I think the blue badge slipped off while parking as the vehicle had been freshly valeted coupled with trying to get in time to the movie I overlooked very important badge.
I appealed to PPC by attaching the valid blue badge.
The appeal was rejected and now I've been referred to the IAS.
I agree I should have been more careful. But it was an honest oversight. Ive never received any parking invoices before from a PPC. The invoice of 100 pounds is a bit harsh.
Ive read that the IAS will not be helpful either but nevertheless I should appeal.
What do you reckon I write to IAS now?

Nothing, appealing to IAS is pointless, see the NEWBIE thread post # 1, which states: -Q - ''My PCN is from an IPC member, should I really not try IAS, and why not?''
A - If it's PCM then give it a go as they seem to enter 'no contests' sometimes, but otherwise, no chance unless you have something ground-shattering like proof there are NO signs up, or if they've said you were the driver/keeper and you are neither (e.g. if you are a non-driving resident and appealed instead of a family member keeper/driver, then it can be fun to expose the PPC to that fact at IAS, proving you can't drive!). Normal appeal facts like 'I was not the driver, no keeper liability' don't cut it with the IAS which is deemed to be a kangaroo court, and losing that stage will make most posters feel worse, and more worried. SO DON'T!0 -
complain to the landowner or cinema citing the EA2010 and insist on a cancellation0

It is quite possible that a person or persons unknown bounced up and down on your car to deliberately dislodge the BB with malice aforethought.
It is also possible it fell off when someone accidently brushed past the car or during strong winds.
I know where I would put my money though.
As above, complain to the landowner and cinema manager about this unregulated scam, citing the EA 2010 as mentioned. The BB scheme does not apply on private and the scammers have no business assuming an occupant of the car is not disabled. A BB is not the only indicator of disability.
Please also complain to your MP about this unregulated scam.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Thank so very much!!!
Ive also received:
Final Notice Letter.
Under Sc.4 POFA sub para (1).a 7.(2) a.b.c.d.e and f. the above named is liable for parking charge etc etc.
Ive already appealed the charge but was refused. I will try to contact the landowner and cineworld but in the mean time do i need to send a reply for the above?0 -
Apart from getting a landowner cancellation, there is nothing for you to do.
If the landowner or cineworld don't do the right thing, then there is nothing further to be done unless you receive either a Letter of Claim or official court correspondence.0 -
The appeal was rejected
They should have allowed the appeal. Service providers are required by law

th make "reasonable adjustment" for people with "protected characteristics" under the Act. IMO, cancellation would fall into this category. Were they to take this to could |I would consider enetering a counter-claim for disability discrimination, in which you could join the landowner.
Also, get your MP on board, they are totally on your side.
On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.
Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
before you send anything to the landowner, post it here firstFrom the Plain Language Commission:
