ESA and Return to work

Hi all,
Not sure if this has already been asked, I did have a quick look but couldn't find anything.
Anyway, my Son has been of work sick for 10 months claiming Income Based Wrag Group, he has decided now that he wants to go back to his job.
He has his capability interview with his boss this week.
He usually works 10 hours a week and earns roughly £280 a month.
Would he still be able to claim ESA while he works part time at his old job?

Hi Tibbers,
I am unsure if he will still get ESA. However if his earnings are under the threshold for ESA (I think £73.10 per week), he 'may' still be entitled to a very limited amount, sometimes £0.25p. In my humble opinion, I would give them a call (be prepared for a long wait lol... )and ask as you have to inform them of any change in circumstances. You could, if you prefer, ring your local CAB or use the Benefits Calculator on this site.
I am aware that you can work while claiming ESA but I do not know hours, pay etc.

OP your son will be able to do permitted work while claiming ESA but he'll need to get permission from DWP before he starts working. Providing it's under 16 hours per week and he earns no more than £125.50 per week then he'll be able to keep all of his ESA. See link.

Do be aware that of the work he does contradicts the reasons why he's claiming ESA then they may re-assess him early and it could go against him once.0 -

Poppy12345 thank you for link, ive just had a look at it and from what i can gather, permitted work isnt for employers, although my son will only be doing maybe 1 or 2 days (4 hour shifts to start with), he wont be able to claim ESA permitted work.
He really wants to go back to his job, but if he can't cope, then he will be of again. It was his job he was signed of from with Stress, Anxiety and Depression.

Permitted work is a benefit arrangement - employers do not offer 'permitted work'.
I've read that as the DWP arrange permitted work and not my son's work? or have i read that wrong?

You've read it wrong. Permitted work is done through DWP not your sons employer.It says this on the link:

Before your son starts work he needs to contact DWP and ask them to send him the PW1 form. Once he receives this then he'll need to fill it out and return it because he needs permission before starting permitted work.
As long as he works less than 16 hours per week and earns no more than £125.50 per week then his full ESA will continue to be paid.0
