Partners housing benefit

Hi,

I am an EU national and living with my partner and 5 month old baby. I am not receiving any benefits apart from child benefit as I don’t fit the criteria but my partner is in full time employment and we are moving out to our own flat in the next couple weeks. I am just wondering if he will be able to claim some H.B even though he works full time. He gets £335 every week so we can’t really make the rent with that on top of other bills and overheads. I have done a few benefit calculations online it am confused because if he does it and selects that he lives with a partner, it automatically assumes I am eligible for certain benefits too. But if he selects that he is a single occupant with the baby, it’s not true. Am I a non dependant tenant? Or how can we calculate what he could potentially get? We do need help with rent as we only have the one income at the moment and as I am not getting any maternity pay I am wondering if i will affect this at all?

    A new claim for housing benefit is no longer possible. All areas are now a full universal credit area since mid December 2018, so he'll have to claim UC and the housing element is in with the monthly payment for this.


    As UC is a means tested benefit you'll have to claim as couple but because of the HRT it's very complicated. I'd advise you both to get some advice from your local citizens advice, or other advice agency.

    As poppy says, you will both need to claim Universal Credit. Your partner cannot claim as a single person. The claim will be assessed as a couple and any money you earn will be taken into account. Whether the standard allowance used in the UC calculation is the couple rate or the single person rate will depend on whether you pass the habitual residence test. UC provides a basic amount to live off, additional money for the baby and help with rent.

    If you will be liable for Council Tax you may be able to claim Council Tax Reduction from you local council.

    Did you follow up any of these suggestions before deciding to move to your own flat?

    Have you applied for settled status as was suggested in this, your earlier thread?

    Did you get advice from your CAB / local advice agency - did you follow up and ring / visit them again?
