HELP: CIFAS Marker- Misuse Facility w/ Barclays

After reading a few other similar threads, I am looking for your advice and guidance with a case with Barclays Bank.

I made an online application with Barclays in Dec 2017 regarding opening a basic current account. They emailed me confirming; Thank you for applying for a Barclays Basic Current Account on 29/12/2017. We'll write to you in the next few days with the results of your application. If it's successful, we'll send you a welcome pack.

I didn't hear back from them regarding the account or if it was successfully opened etc. I received an email on the 5th Feb 2018 :Welcome to Pingit Account number ending in 8241@ 10:26.

I didn't pay much attention to it as I was on holiday however noticed when I got back, I received a text each from Lloyds Banks & Halifax Bank advising after a review on my account(s), a decision to close the account was made & the account facilities were withdrawn and the account(s) to be closed in 60 days. These were received on 13/03/2018. I subsequently have had both accounts closed. Luckily, I also had a Monzo account where I then had my wages etc put in and my day to day account.

I recently tried to open a Metro account as received a small tax rebate and wanted a basic account. Ofcourse I was declined which led me to to apply to TSB which was also declined. I then requested CIFAS to send me a posted copy by submitting a SAR request. Having received this, there is now a marker for - FIrst Party Fraud recorded by Barclays Bank PLC on the 12/Feb/2018.

So this is what I have been able to find out from Barclays earlier on;

I previously had a student account ( with overdraft facility) and a current account when I was a teenager. And when at university, my term time address was my student accommodation. Whilst I used my home address which was also my main address for the application made in Dec 2017, Barclays confirm they have sent off correspondence including debit card + pin to my "University address".

Now I haven't been at this University address since January 2014 so not sure why Barclays have sent this there. There is a separate issue of data breach which I will also be raising with the Student Accommodation as clearly someone ( either working there or a tenant at the same address) has obtained credentials and gone on to misuse the facility.

CIFAS insist the first point of contact should be Barclays and so I want to know how to go about it as raising an official complaint seems my only route in order to remove the marker?

    Terrible service. They should not have sent anything to an out of date address from an old record. Edit: I'm assuming they had this address from an old account? If it was actually an active account and you hadn't changed the address, then that's obviously a bit different!

    You need to write immediately to Barclays, and

    - Describe all of the events
    - State how you have been materially disadvantaged (closed bank accounts, stress and hassle etc)
    - Request to make a formal complaint

    If things are as described you really ought to be due quite a large amount of compensation, as well as getting them to remove the marker.

    However, this will take time; potentially several months if it needs to go to FOS, so good job you have an account that works.

    *by large amount of compensation, I mean c.£200 - £500 , just before you start planning your retirement!

    They sent a bank card and PIN to the wrong address, which has resulted in fraud being committed in the OPs name, CIFAS, bank account closures and clearly a lot of hassle and stress.

    I'd think compensation perfectly reasonable for this, as (I'm completely convinced) would FOS. It's exactly the sort of thing FOS regulation and compensation is there for.

    The guidance from the FOS for wrongly applied CIFAS is £1000-£1500 compensation.

    This will be much to Garry’s disgust.

    This is a very serious complaint plus a DPA breach at least another £250 for that. If I was dealing with this complaint I’d probably round it up to 2k
