Regarding ParkingEye PCN

Hello I was hoping you could tell me whether or not I have enough material and evidence to appeal this PCN which my father has unfortunately received due to an overstay in his local supermarket car park.

The actual Parking Charge notice displays only a photo of the car and it’s vehicle registration but not the driver. He always displays a blue badge as he’s registered disabled (as is his car) but the car park only allows a maximum of two hours and he unfortunately did not get back to the car in the warranted time.

Would really appreciate your help with this,

After looking at the NEWBIES thread I seem to think the ‘one size fits all’ template is the way to go about this. Could you please advise?

    No such thing as registered disabled, and hasn't been for about 40 years...

    Dad and you (together is good) should go into the Store with his Blue Badge and the PCN, and complain to the Store Manager that disabled people are not being given a reasonable adjustment of time, and can they:

    - cancel this unfair PCN, and

    - add his VRN to an exempt list to stop this con happening ever again.


    Do that first (the NEWBIES thread does say always complain, first).

    Page 9 - section 13 talks about grace periods (you didn't mention how much longer your father took) and section 16 talks about how they should treat disabled motorists.

    All the PE signs that I have come across fail imo to be able to form a contract. They are either too high, the font is too smaal, or they are too wordy, or all ot the above, read this thread and complain to your MP.

    Complain to your MP. On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    Can't agree there, DP, and nor did the Supreme Court, so lesser Judges are unlikely to view P/Eye's signs, with the parking charge on a bold background, as especially wanting. The only P/Eye cases we win on signage, at POPLA, are where it was dark and the signs were not lit.

    The OP needs to complain to get it cancelled, well before trying POPLA.
