No, your insurers have an overiding obligation to treat your failry anf cannot simply cancel the policy unilatteraly simply because you made a claim and refuse to deal with the claim. They can cancel a policy if you failed to make a declaration when taking out the policy under certain circumstances. Making a genuine error for which they are under normal circumstances prepared to take on the risk - which they had done - for an additional premium implies that the action they have taken is "unfair". Their correct remedy was to make an additional charge from the day you reported the accident, but to scale back the claim by the percentage of underpaid premium.

I suggest you firstly make a complaint stating that your mistike was genuine, because you had believed that motor uinsurance generally and normalyly included commuting to and from work. Further remind them that they were happy to accept the risk for an additional premium. State that you believe that the subsequent "change of mind" was unfair. If they fail to agree take it to the ombudsman that has in previous similar situations found for the insured rather than insurer.

This is simply my opinion based on my understanding of your OP . Good luck.
Thank you for your response .

To play Devil's Advocate here - what would happen if the van driver claimed against you because he hit an uninsured driver who should not have been driving uninsured and therefore should not have been on the road in the first place?

    Could happen.

    Course it couldn't

You look to be suggesting that if you ploughed into a pedestrian on the pavement and killed him you wouldn't be liable if it turned out that the pedestrian was an escapee from wormwood scrubs so should never have been on the pavement!
  • The accident was not my fault . I was sitting in traffic and a BT van hit the back of my car with great force ! When the driver got out of his car he apologise and made a passing comment , "that will teach me not to daydream" As far I was concerned I was insured to drive and have been doing so to work constantly . It was a stupid oversight that I had not added commuting .

I should have been on the road! Just not driving from work . If I was driving from the shops or elsewhere then that would have been fine !

I think the claim is the least of your problems which you can proceed via the third part insurance.

You now have to declare a cancelled insurance which will hit your premiums high or make it difficult to find insurance of any kind. Good luck, that mistake is going to cost you dear

I am well aware of my problems and you really do not need to point them out . Thank you for advising me how I can claim .

What does the cancellation letter say exactly ?

Are they refusing to deal with your claim, because you had the wrong cover ?

Did you admit to Go Skippy that you had the wrong cover at the time of the accident ?

How did you buy the Insurance orginally ? Direct from Go Skippy or via a comparison site ?

Your Insurance certificate should state the cover that you had. Did you ever read this fully ? if you did, was it clear to you what cover you had arranged. I ask this, as Insurance is sold online to people, when they do not have much understanding of Insurance.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

Yes , they are refusing to dealt with the claim because it was wrong cover ( fully understand this )
When I reported the accident , I told them I was driving from work .
I got the cover via comparison site and have never had the hard copy paper . I suppose I could have gone to my portal to check documents but did not . Not a mistake I am ever going to make again !
I have accepted the blunder I have made and so not going to communicate with Go Skippy about the matter .

Yes, until the OP is insured or caught driving.
