£95 is a MAX. You needed to have the CPRs to hand - never assume, have proof - to show you are entitled and its not discretionary.0

Ok so to confirm, for my next case, after the DJ dismisses the case, I should thank them and state now i wish to pursue my costs as stated in the CPR section 7.3 which states loss of earnings at a maximum of £95 and here is my payslip.
This time i didn't state the CPR section or mention it when asking for costs. Hopefully that would cover it.0 -

DJ said you should be happy with the result, nodded his head up and down and said its been dismissed but I sat there thinking what is this, I was more interested in my costs tbh.
Some judges fail to understand about costs. Must have been one of the old school types who remembers the "nodding dog" we used to see in the back of cars in the last century.

If the next hearing is about the SAME SIGN, why not email the Claimant/solicitor now, and tell them to cancel and discontinue as their sign was found wanting and they have no cause of action...and that next time you will be citing the CPRs to ensure your costs are granted - so you urge them to cut their losses and give up.
