Parking fine from APCOA need some help and advise

Options
Hi

I received a parking charge notice today from APCOA I wish to appeal this as I was waiting to pick someone up from A train station and there train was delayed.

I never left my car or switched my car off I had no choice but wait in the car park until they arrived.

What do I need to do first ?

I was in the car park less than 20mins

The date I got this fine was 24/02/19 which was the date I collected the person from the train station but have only just received the fine which is today 21/03/19.

I have read the newbies post but I’m a bit confused on what to do next do I go to their websit and start an appeal ?

Any help would be greatly appreciated as I have never had one of these before

No confusion, just crack on with appealing using the forum template.

Obviously DO NOT add daft things like this! Eeeek, no saying who was driving!

No need for any threads about easy ones like APCOA, who will lose in the end at POPLA, with you merely copying any other APCOA RAILWAY POPLA thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

and once you have appealed as keeper with the blue text template , read this , where most of the work has been done for you, plus read and what transpired and why they appealed as a keeper and how keeper liability doesnt apply at train stations

    https://forums.moneysavingexpert.com/discussion/5803128/parking-charge-notice-apoca

the keeper wins on a techicality, not on "what happened" , but drivers lose due to blabbing about who was driving
  • Thank you I will get it typed out and posted first thing tomorrow

Complain to your MP. On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
You never know how far you can go until you go too far.
  • Ok so I got my response back from them today and they are saying my appeal was unsuccessful now what do I do ?

They are saying as the registered keeper of the car I have to pay the parking charge.

yeah , they always say that (well they would , wouldnt they ?)

its completely irrelevant anyway , because they must have given you a POPLA code as well ?

in which case , read post #3 above again and read the link I gave , where most of the work has been done for you in order to make your popla appeal, by adapting the one posted in there

I can assure you that APCOA are completely wrong because no RK is liable for a pcn on railway land, so the keeper can say so in their popla appeal , hence why we say DO NOT REVEAL WHO WAS DRIVING

the law is the law, and as soon as your POPLA appeal is made, apcoa will throw in the towel because you will have caught them out
  • My Appeal was unsuccessful.

Do I then re appeal it with them using the 2nd letter on this forum?

They are saying as I’m the registered keeper I am liable for the penalty charge and have 14 days to either pay or I can go through to POPLA where my charge may go up to £85 as it will then go over the 14 days

of course its unsuccessful, they NEVER accept any appeals , none at all, so fully expected

the idea was to get the popla code and appeal to popla , and I already linked a previous appeal you can adapt for popla (forget the 14 days and the £85 because you wont be doing those)

read my previous answers and draft your popla appeal, based on the one I linked

they can assert whatever they like , lie and cheat like they do, but the law does not say that an RK is liable, so they lied and your popla appeal will show them up for liars when they withdraw

ps:- that thread I linked to , the popla appeal from last year has a lot of forum errors in it where this forum does not like certain keyboard characters, so all those spurious bits need deleting after you copy and paste it into word or wordpad or notepad
