DFS nightmare

Can anyone help me out please i bought a recliner chair and recliner couch from dfs on finance. I have only had it 5 weeks and it looks years old all the leather as stretched really badly. The manager as came out today and told me they will not change it only repair it which consists of putting new foam in all the back of the couch and chair and also in the arms of the cushions witch look like pancakes already i told him i wasnt happy and if they had a picture in store telling me this is how its going to look in 5 weeks time i would never of purchased it, They are coming out on tuesday to do the repair can i still reject this and were do i stand he told me they will not change this for me

    They have the right to effect one repair before you are permitted to reject it.
  • We bought a sofa for my son and the back looks really flattened in after a few months.


    The quality is rubbish,chinese imports I presume.

    Outside of 30 days you do have to allow them one chance to repair unfortunately. I know it's frustrating but that is sadly the law. The right to reject only applies within the first 30 days after receiving the goods. The good news is that if after the repair the same thing happens you then DO have the right to refuse another repair and reject the goods, but they don't have to give you a full refund as they can deduct money for use of the product, but this has to be fair.

    It all depends on when the 2nd failure happens.
    If it's within 6 months from purchase then no, the retailer can't make any deduction for the use of the item.
    The only time this doesn't apply is for the sale of motor vehicles.

    Not that this really helps the OP with her query, but I shall respond anyway. Yes, sorry, you're right, within the first 6 months a full refund must be given. I suppose it might be likely for this to happen again within 6 months, I hadn't considered that.

    Thanks for the replies they have came out today and put more foam in the back and cushions but the back of the couch is now like i have a brick in my back after only sitting on it for half an hour my back is in bulk its looks better but is so uncomfortable i will just have to wait and see if it softens but i doubt that it will am only 8 stone so am not likely to flatten it anytime soon
