That paragraph in the template appeal is talking about an OVERSTAY (i.e. over and above allowed parking time, where there is, say, 2 hours free or a Pay & Display car park where the person did pay). In that case it is reasonable to argue that an observation period applies before allowed parking time, and a grace period after.
A person driving in and not paying, then leaving, is not an overstay situation and you can't just rely on my wording about overstays, to imagine that you have 20 minutes on site when it's not an 'overstay'.
You will lose at POPLA if you keep pushing that hopeless argument (sorry).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
